Usage of the website service
The provision of the website service is at the discretion of Shopfit Central who may terminate or suspend the operation of the website at any time and from time to time.
Relationship
Shopfit Central does not act as agent of the Premium Partner for any purpose. Shopfit Central merely provides a facility by which Shopfit Central is able to introduce customers to Premium Partners. Shopfit Central has no authority to incur any obligation or liability on behalf of the Premium Partner or to enter into any commitment binding the Premium Partner. Shopfit Central and the Premium Partner are not in a joint venture relationship.
Impartiality
Shopfit Central will use reasonable commercial endeavours to ensure that all information presented on the website is presented in an impartial manner as between competing Premium Partners and without any Premium Partner being given greater prominence or having its information presented in a more favourable format than any other Premium Partner. However, the Premium Partner recognises that information relating to competing Premium Partners must necessarily be presented in the form of lists and tables and Shopfit Central will not be regarded as contravening its impartiality commitment as a result of one Premium Partner appearing higher on a list or table than another Premium Partner. The website will allow Customers to choose to view quotes and information provided by the particular Premium Partners. The impartiality obligation of Shopfit Central does not apply to this data. However, Shopfit Central will apply limitations regarding this data and information that are consistent as between competing Premium Partners.
Indemnity
The Premium Partner indemnifies Shopfit Central and each of its directors, officers and employees (an Indemnified Party) against all loss, damage, liability and claims suffered or incurred by an Indemnified Party as a result of any breach by the Premium Partner of any obligation imposed on the Premium Partner by these terms and conditions or as a result of any information, data or document provided by the Premium Partner to Shopfit Central in connection with the website being false, misleading of deceptive in any manner whatsoever or not being in compliance with all applicable laws.
Privacy
Shopfit Central must comply with all applicable privacy laws in relation to all information concerning a customer that is obtained by the Premium Partner or Shopfit Central through the use by the customer of the website.
GST
All quote prices available may or may not include GST. This is the Australian Goods and Services Tax.
Intellectual Property Rights
Shopfit Central holds determines from the information received from entry into the website by a customer a list of relevant results. It is assumed that this information entered is correct and relates to your specific job requirements. From time to time this information that has been entered maybe collected to ensure the website is delivering the best available service to you. We understand your personal information is important and we undertake a responsibility to protect it from misuse. It is acknowledged and accepted by you as a user of Shopfit Central that all other intellectual property including copyright, trademarks, material and content provided within the website belong to Shopfit Central. This material and quotes may be downloaded. All users agree that this information will not be replicated, published, transmitted, displayed or distributed commercially without the written consent of Shopfit Central.
Dispute resolution
Any dispute, controversy or claim (a "dispute") arises between a customer and Shopfit Central in connection with these terms and conditions, the relationship between Shopfit Central and the Premium Partner, or any transaction effected with a Customer in connection with the website, must be dealt with in accordance with the procedures. Where an issue arises with the website, its results or data displayed Shopfit Central invites the customer to contact us directly. We will take a minimum of twenty-four hours to respond and thereafter use reasonable endeavours to resolve the dispute in good faith. We will ensure Shopfit Central will deal with all maters directly and efficiently.
Governing law
Shopfit Central our website and these terms and conditions are governed by the laws of Queensland.
